Laws & Compliance

EcoSolve Recycling operates within the South African legal framework that governs privacy, information security, waste management, consumer protection and business conduct. This page summarises the key laws we follow and how they apply to our services.

Protection of Personal Information Act 4 of 2013 (POPIA)

Governs how personal information is collected, used, stored, shared and destroyed. EcoSolve applies the eight POPIA conditions for lawful processing: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards and data subject participation. Our secure shredding and destruction services help clients meet their own POPIA obligation to destroy records that are no longer needed.

Promotion of Access to Information Act 2 of 2000 (PAIA)

Gives people the right to request access to records held by private and public bodies. Requests for records held by EcoSolve Recycling can be sent to our Information Officer at ecosolverecycling@gmail.com.

National Environmental Management Act 107 of 1998 (NEMA)

Sets out South Africa's environmental principles, including the duty of care to prevent pollution and environmental degradation. EcoSolve aims to divert recyclable materials from landfill and to handle every collection responsibly.

National Environmental Management: Waste Act 59 of 2008

Regulates waste management, recycling, storage, transport and disposal, and requires waste to be handled in a way that avoids harm to health and the environment. Hazardous items such as lithium batteries and certain e-waste components are separated and routed to appropriate downstream processors.

Extended Producer Responsibility (EPR) Regulations, 2020

Made under the Waste Act, these regulations make producers responsible for the end-of-life management of products in sectors such as paper and packaging, electrical and electronic equipment, and lighting. EcoSolve supports the recycling chain that these schemes rely on.

Second-Hand Goods Act 6 of 2009

Regulates dealers in second-hand goods, including scrap metal, and requires record-keeping to help prevent the trade in stolen goods, such as stolen cable and infrastructure metal. EcoSolve may request identification and proof of ownership before accepting certain metal items.

Electronic Communications and Transactions Act 25 of 2002 (ECTA)

Recognises electronic records and signatures, and sets disclosure requirements for businesses that operate online. Our website identifies EcoSolve Recycling and provides our contact details, terms and privacy information as required.

Consumer Protection Act 68 of 2008 (CPA)

Protects consumers' rights to fair, honest and transparent dealings, plain-language information, fair pricing disclosure and quality service. Our Terms of Service are written to align with the CPA where it applies.

Value-Added Tax Act 89 of 1991 and Tax Administration Act 28 of 2011

Govern how prices, invoices and tax are handled and how long financial records must be kept. EcoSolve will clearly state whether prices include VAT on quotes and invoices.

Occupational Health and Safety Act 85 of 1993 (OHSA)

Requires a safe working environment for employees and anyone affected by our work. Our teams follow safe lifting, handling and transport practices during collections.

Cybercrimes Act 19 of 2020

Criminalises unlawful access to, interception of and interference with data and computer systems. Data-bearing devices received for e-waste recycling or destruction are handled under controlled conditions.
