EcoSolve Recycling
Terms of Service
These Terms of Service govern your use of the EcoSolve Recycling website and the quotation, collection, recycling and document services we provide. By using this website or accepting a quotation, you agree to these terms. They are written to be read together with the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and the Protection of Personal Information Act 4 of 2013.
1. About us and these terms
"EcoSolve Recycling", "EcoSolve", "we", "us" and "our" refer to EcoSolve Recycling, operating in South Africa. "You" and "customer" refer to the person or business using this website or requesting our services.
A written quotation or service agreement accepted by both parties applies to that specific booking. Where it conflicts with these terms, the accepted quotation or agreement takes precedence.
2. Enquiries, quotations and bookings
Information and prices on this website are a general guide. Submitting an enquiry by WhatsApp or email does not create a contract. A booking is confirmed only once EcoSolve has confirmed the service, materials, quantity, collection address, date and price with you in writing (including by WhatsApp or email).
Quotations are valid for 30 days unless stated otherwise and are based on the information you provide. If the actual materials, quantity, access conditions or location differ materially, we may revise the quotation before or at collection, and you may then decline the service.
Unless a quotation states otherwise, prices are quoted in South African Rand. Whether VAT is included will be stated on the quotation or invoice.
3. Subscriptions and recurring collection plans
Recurring plans (such as monthly secure shredding boxes) run for the period stated in your quotation. The included collection frequency, box capacity and any additional charges will be confirmed in writing before the plan starts.
Where the Consumer Protection Act applies to you, you may cancel a fixed-term agreement on 20 business days' written notice, subject to a reasonable cancellation charge as allowed by section 14 of that Act. Business customers not covered by the Act may cancel as set out in their quotation or agreement.
4. Your responsibilities
You confirm that you own, or are authorised to dispose of, all materials you hand to us, and that the information you provide is accurate.
You must disclose any hazardous, regulated or dangerous materials, including lithium batteries, chemicals, asbestos, gas cylinders, medical waste or items containing fluids, before collection. We may refuse, or charge extra to handle, undisclosed materials.
You agree to provide safe, reasonable access to the collection point at the agreed time. Failed collections caused by lack of access or materials not being ready may be charged.
5. Collection, ownership and risk
Ownership of and risk in materials pass to EcoSolve when our team has collected them and signed for them, or when you deliver them to our premises and we accept them.
Once materials have been handed over for destruction or recycling, they cannot be returned. Please remove anything you wish to keep before collection, including items in storage boxes, drawers, devices and media.
6. Document destruction and data-bearing devices
Confidential documents and data-bearing devices are handled under a controlled chain of custody from collection to destruction. Where your service includes a certificate of destruction, it records the date, customer and description of the materials destroyed.
You remain the responsible party for personal information under POPIA until it is handed to us. We act as an operator in respect of that information and process it only to destroy it, in line with section 21 of POPIA. Removing personal data from devices before collection, where practical, is recommended.
7. Recycling and payment for materials
Where EcoSolve agrees to pay for recyclable materials, any rate is confirmed at the time of quotation or weighing and depends on the material type, grade, cleanliness and current market conditions. We comply with the Second-Hand Goods Act 6 of 2009 and may require identification and proof of ownership before accepting certain metals.
8. Payment
Invoices are payable within the period stated on the invoice, or on collection for once-off services, unless otherwise agreed. We may suspend recurring services if payments are overdue.
9. Limitation of liability
To the extent permitted by law, EcoSolve is not liable for indirect or consequential loss, or for loss caused by inaccurate information, undisclosed hazardous materials or circumstances beyond our reasonable control. Our total liability for any booking is limited to the amount paid for that booking.
Nothing in these terms limits any right you have under the Consumer Protection Act or excludes liability for gross negligence or wilful misconduct.
10. Website use and intellectual property
The EcoSolve Recycling name, logo, website content and images belong to EcoSolve or its licensors and may not be copied or used without permission. You may not use this website unlawfully, attempt to disrupt it, or submit false enquiries.
This website may link to third-party services such as WhatsApp. We are not responsible for the content or privacy practices of those services.
11. Privacy
We collect and use personal information in accordance with our Privacy Policy and POPIA. Please read our Privacy Policy for how we handle the details you share with us.
12. Disputes, governing law and changes
Please contact us first so we can try to resolve any concern. These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
We may update these terms from time to time. The version published on this page applies from the date shown below. Contact: Brett on 063 024 0749 (call or WhatsApp) or ecosolverecycling@gmail.com.
